We are currently supporting our client in the appointment of an experienced Head of Clinical Legal Services. Reporting to the Chief Medical Officer, the post holder will lead the Litigation and Inquests Team, acting as the Trust’s specialist advisor on healthcare law, clinical claims, inquests and complex legal matters.
About the Role
You will provide expert advice and leadership on a wide range of clinical legal issues, ensuring the Trust manages claims, inquests and legal risks effectively while supporting learning and improvement across the organisation. The role will involve working closely with NHS Resolution, external solicitors, Coroners, clinicians, senior leaders and multidisciplinary teams to manage complex and sensitive legal matters.
Key Responsibilities
- Lead and manage the Litigation and Inquests function across the Trust
- Provide expert advice on clinical negligence, personal injury claims, healthcare law and coronial matters
- Act as the Trust lead for complex inquests, representing the organisation at Coroner’s Court where required
- Manage clinical and non-clinical claims in partnership with NHS Resolution and external legal advisors
- Act as the gatekeeper for external legal advice relating to healthcare law matters, including consent, complex discharges, Court of Protection, mental capacity and best interest decisions
- Lead urgent Court of Protection applications to the High Court where required
- Support clinicians and teams through complex legal processes, including preparation of statements and court documentation
- Facilitate MDT meetings with internal and external stakeholders
- Provide advice and guidance on legal risks, liability, investigations and reputational issues
- Analyse claims and inquest data to identify learning opportunities and support patient safety improvements
- Develop and implement policies, procedures and training relating to claims and inquest management
- Present reports and recommendations to senior leadership teams, committees and Trust Boards
- Build strong relationships with NHS Resolution, Coroners’ Offices, legal representatives and internal stakeholders
About You
The successful candidate will have:
- Significant experience managing clinical claims and inquests within an NHS setting
- A relevant legal qualification (Solicitor / Legal Executive desirable) or equivalent specialist clinical claims experience
- Strong knowledge of NHS Resolution processes, healthcare law and coronial procedures
- Experience managing complex inquests and attending Coroner’s Court
- Experience providing specialist legal advice within a healthcare environment
- Experience instructing and working with external solicitors and legal counsel
- Strong understanding of clinical negligence, personal injury claims and litigation processes
- Experience handling sensitive, complex and emotionally challenging situations
- Excellent communication, negotiation and influencing skills
- Ability to present complex information to senior leaders and clinical audiences
- Experience using claims data, reporting systems and risk information to drive improvement
Essential Requirements
- NHS experience within clinical claims, litigation or inquest management
- Experience of managing complex legal cases and sensitive investigations
- Ability to attend court and represent/support the Trust when required
- Strong understanding of healthcare governance, patient safety and legal frameworks
- Ability to work autonomously and manage competing priorities within a fast-paced environment
