The Crofting Commission is responsible for regulating the crofting system and promoting the interests of crofting to ensure its future sustainability. This new role will sit within the Legal and Regulatory Support Team which is primarily responsible for proving legal advice and guidance to the wider Commission, dealing with appeals against Commission decisions to the Scottish Land Court, administering the Commission’s scheme of Delegation decision making, preparing responses to complex casework and procedural queries, issuing procedural guidance and preparing materials and delivery training to both Commission and SGRPID staff.
The Crofting Regulatory Support Officer is a new role within the Commission and will include supporting the Commission solicitor and other team members in undertaking the tasks associated with the implementation of the Crofting and Land Court Bill currently going through parliament, with a particular emphasis on the changes which will impact upon the Commission’s Duties Enforcement processes and related applications or notifications, liaising with colleagues from the Commission’s Residence and Land Use Team (RALUT) who are the team responsible for duties enforcement. This will involve participating in identifying and implementing the changes required to our current forms, associated documentation, procedures, guidance etc to deliver the changes brought in by the new Bill. The role will also involve participating in the delegated decision making process; drafting grounds for complex casework decisions; and providing support to the solicitor and other team members in the range of tasks involved in providing legal and regulatory support to the wider Commission.
Responsibilities
- Take the lead in the implementation of those changes introduced by the new Crofting Bill which will directly impact upon the Commission’s Duties enforcement processes and associated applications, requiring changes to workflows; forms; letters and other supporting documentation; guidance, workflows etc.
- Keep under review and update the content of the Commission’s published “Law, Policy and Procedure” documents relating to Duties Enforcement processes to reflect legislative and policy changes.
- Participate in the implementation of those changes introduced by the new Crofting Bill which will impact upon the Commission’s Regulatory application and notification casework processes, requiring changes to workflows; forms; letters and other supporting documentation; guidance, etc.
- Participate in and draft grounds for complex casework decisions as part of the Commission’s Scheme of Delegated decision making.
- Provide administrative support to the Commission solicitor as required, with particular focus on matters relating to the new Crofting Bill.
- Provide support to other team members in responding to queries on complex casework and procedural matters.
- Participate in the preparation of training materials and the delivery of training to Commission and SGRPID colleagues.
- It is anticipated that once the tasks related to the changes to the new Crofting Bill are implemented, that part of the duties of the post will be to take on tasks relating to processing Duties Enforcement casework as part of the Commission’s Residence and Land Use Team (RALUT).

The Crofting Commission is a Non-Departmental Public Body (NDPB) whose officials are provided by Scottish Ministers. The Commission act as a crofting regulator aiming to promote occupancy of crofts, active land use, and shared management by crofters as a means of sustaining and enhancing rural communities. The Commission is also responsible for maintaining the Register of Crofts.

Working Pattern
Our standard hours are 35 hours per week. The post will be primarily based in Great Glen House (Inverness) and from home, or another Highland and Islands Scottish Government office in accordance with the Scottish Government and Commission’s policies on hybrid working. The selection will be on merit irrespective of applicants’ home addresses. Any successful applicant must be able to attend the Great Glen House office when necessary.
Security Checks
Successful candidates must complete the Baseline Personnel Security Standard (BPSS), before they can be appointed. BPSS is comprised of four main pre-employment checks – Identity, Right to work, Employment History and a Criminal Record check (unspent convictions).
