Job Title - Testamentary Capacity Assessor

Position Description

We’re seeking a clinically grounded, legally literate professional to join our growing network of testamentary capacity assessors. This role suits psychologists, psychiatrists, social workers, or mental health professionals with a passion for safeguarding autonomy, dignity, and legal clarity in complex decision‑making contexts. This role offers a unique opportunity to shape ethical practice in a growing medico‑legal field, supporting autonomy and clarity in some of life’s most important decisions.

Role Overview

You’ll conduct independent assessments of testamentary capacity, applying the Banks v Goodfellow test and producing legally robust reports for solicitors, families, and estate planners. Cases often involve older adults, neurodiverse individuals, or those navigating cognitive or mental health challenges. You’ll work flexibly, with access to clinical supervision, operational support, and sector‑informed templates.

Responsibilities & Qualifications

  • Must be registered as self‑employed
  • HCPC, NMC, or Social Work England registration required
  • Qualified to complete testamentary capacity assessments
  • Clinical background in mental health, psychology, social care, or law
  • Experience conducting capacity assessments
  • Familiarity with the Banks v Goodfellow test and its legal application
  • Excellent understanding of relevant legislation and frameworks, including the Mental Capacity Act 2005
  • Awareness of common‑law principles and medico‑legal risks
  • Ability to work independently or as part of a multidisciplinary/interdisciplinary team
  • Strong report‑writing and documentation skills
  • Clear, professional communication with legal and clinical stakeholders
  • Ethical, strengths‑based approach to safeguarding and autonomy
  • Flexible availability
  • Full UK driving licence and access to a vehicle with business‑use insurance
  • Training in forensic or medico‑legal assessment
  • Experience producing court reports or acting as an expert witness
  • Familiarity with digital documentation systems and remote assessment protocols
  • Commitment to trauma‑informed, autonomy‑supportive practice
  • Knowledge of cultural, linguistic, and neurodiversity considerations in capacity assessments
  • Experience working with older adults, neurodegenerative conditions, or palliative care
  • Ability to translate clinical findings into accessible, legally robust language
