Our client is seeking an experienced and dedicated Court of Protection Solicitor (Health & Welfare) to join their growing specialist team. This is an excellent opportunity to work in a highly rewarding and complex area of law, representing vulnerable adults and their families in sensitive and impactful matters.
The successful candidate will manage a varied caseload of Health & Welfare Court of Protection matters. This includes applications and proceedings relating to capacity, best interests, residence, care and contact, as well as applications brought under Section 21A of the Mental Capacity Act 2005.
Key Responsibilities- Managing a caseload of Health & Welfare Court of Protection matters.
- Drafting applications, witness statements, and a range of court documents.
- Instructing counsel where appropriate.
- Attending and, where suitable, conducting advocacy at Court of Protection hearings.
- Advising clients, family members, professionals, and deputies on capacity and best-interests issues.
- Working collaboratively with the Official Solicitor, local authorities, healthcare professionals, and care providers.
- Ensuring compliance with the Mental Capacity Act 2005, Care Act 2014, and relevant case law.
- Supervising junior colleagues as required.
- Qualified Solicitor in England & Wales.
- Demonstrable experience within Court of Protection (Health & Welfare) work.
- Strong knowledge of the Mental Capacity Act 2005, Care Act 2014, and associated case law.
- Knowledge of Civil Legal Aid is advantageous.
- Excellent drafting, communication, and advocacy skills.
- Compassionate, client-centred approach with strong attention to detail.
- Ability to manage your own caseload while contributing positively to a collaborative team.
