The Credit Hire Litigation Executive will be responsible for the day-to-day management of a caseload of credit hire, storage and recovery claims, including complex, high-value matters. The role requires a strong working knowledge of credit hire law, the Civil Procedure Rules, and current appellate authority. The successful candidate will be expected to run files proactively from pre-litigation through to trial, with minimal supervision.
Key Responsibilities
- Case Handling & Litigation
- Manage a full caseload of credit hire, storage and recovery claims (SDP and Taxi/PHV), including high-value and multi-issue matters
- Draft and review Particulars of Claim, Replies, Schedules and Statements
- Prepare and respond to Part 36 offers, Calderbank offers, and settlement correspondence
- Conduct liability, quantum, need, period, rate, impecuniosity and intervention assessments
- Prepare witness statements, including statements addressing need, impecuniosity and mitigation
- Liaise with counsel where appropriate and assist with instructions and trial preparation
- Legal Analysis & Strategy
- Apply and distinguish relevant credit hire case law, including but not limited to: Lagden v O’Connor, Stevens v Equity, Clark v Ardington, Copley v Lawn, Holt v Allianz, Giles v Thompson
- Assess Basic Hire Rate (BHR) evidence and challenge insurer-led BHR reports
- Advise on intervention offers, mitigation arguments and evidential strategy
- Identify procedural defects and tactical opportunities under the CPR
- Procedural Compliance
- Ensure strict compliance with the Civil Procedure Rules, including PD 16, PD 22, Part 3, Part 18, Part 36 and costs regimes
- Manage deadlines, limitation dates and court orders
- Prepare and respond to applications, including strike out, relief from sanctions, and amendment applications
- Client Liaison
- Act as the primary point of contact for clients, credit hire organisations (CHOs), storage and recovery providers
- Provide clear, pragmatic advice to clients on prospects, risks and settlement strategy
- Maintain professional relationships with insurers, solicitors, counsel and experts
- File Management & Compliance
- Maintain accurate, compliant and audit-ready files
- Ensure adherence to internal procedures, SRA standards (where applicable), and data protection obligations
- Record time and outcomes accurately in accordance with firm policies
Required Experience & Skills
- Essential
- Minimum 2+ years’ experience handling credit hire litigation on the claimant side
- Strong working knowledge of credit hire law and practice
- Proven experience running files from inception to trial
- Excellent drafting skills and attention to detail
- Confident application of CPR and procedural rules
- Ability to work independently and manage competing deadlines
- Desirable
- Experience with high-value (£50k+) credit hire claims
- Experience dealing with Taxi / PHV hire claims
