Positive Employment is currently recruiting for a Legal Advisor for our client, a government organisation in North Somerset. The organisation is working in partnership with town and parish councils across North Somerset to transfer land and other assets to them and for them to take on new responsibilities for maintaining and managing community areas such as open spaces, parks, playgrounds, village halls, etc., which will enable decisions to be made at a more local level and give communities greater control in their local neighbourhoods. It is initially estimated that there could be around 400 parcels of land to be transferred, albeit there could be a portfolio of titles under a single transfer. The successful candidate may be required to undertake other property matters such as acquisitions, leases, licences, and landlord and tenant matters. This role is a fixed term contract for 12 months.

Duties and Responsibilities (but not limited to):

  • Transfers of whole and part.
  • Investigating title and having knowledge and experience of property related matters, for example, covenants, easements, reservations, and the grant of new rights.
  • Drafting, amending and agreement of transfers and other legal property documents including selecting and adapting the right precedents or drafting from new.
  • Overage clauses and rights of pre-emption in favour of the organisation – separate overage deeds (including rights of pre-emption) may be required.
  • Knowledge and experience of s.106 Agreements - areas of open space may have transferred to the Council under such agreements.
  • Attending meetings unsupervised, including virtual meetings with instructing officers and Members and external parties.
  • Knowledge of s123 Local Government Act 1972, although the post holder will not be expected to advertise the disposal.

Personal Requirements:

  • Experience of working in local government legal practice (Desirable).
  • Able to demonstrate practising experience in property law and practice.
  • The ability to draft, negotiate and complete original documents.
  • The ability to understand and analyse legal documents and give clear and accurate legal advice.
  • The ability to negotiate effectively to secure the best possible outcomes for the organisation.
  • Clear, concise, and modern written, typed, and verbal communication skills with the ability to explain the law and any legal issues and drafting points clearly and simply to maximise the client’s understanding.
  • The ability to use all available methods of research.
  • An experienced property lawyer – either a person admitted as a solicitor or Fellow Chartered Legal Executive.

Working Hours: 37 hrs / 9:00am - 17:00pm / Monday - Friday

Pay: £31.86 per hr

Please note this role is within the scope of IR35.
