Job Description

The Legal Team provides legal and regulatory advice to ensure that all Crypto.com products and services are compliant per local regulations while also meeting the needs of Crypto.com customers. The Legal Team interfaces externally with regulators and service providers in order to demonstrate compliance with applicable law and regulation for Crypto.com.
This role will report to the Global Head of Capital Markets, Legal and will also work closely with the Legal Team in the EU. The primary focus for this role will be to serve as the Legal Team’s expert on the law and regulations applicable to EU Investment Firms and the products offered throughout the EU. The Legal Team provides proactive and solution-oriented legal and regulatory advice and guidance to multiple stakeholders to enable the development and launch of Crypto.com products and services in a way that meets our obligations as well as the needs of our customers. Work cross-functionally to identify, analyze, and mitigate legal and regulatory risks (while maximizing commercial opportunities) related to the introduction of new products and services. Also represents Crypto.com on a variety of topics before regulators, financial partners, and other external audiences.

Responsibilities

  • You will be part of the Crypto.com Legal Team handling legal and regulatory matters for Crypto.com’s Investment Firm based in the EU.
  • Expertise in the the following regulations, including the interaction of these regulations in the EU and on a cross-border basis will be key for this role: Markets In Financial Instruments Directive (MiFID); Markets in Financial Instruments Regulation (MiFIR); Investment Firms Regulation and Directive (IFR/IFD); the Regulation on Market Abuse (MAR), and Markets in Crypto-Assets Regulation (MiCA).
  • Focus on legal and regulatory matters involving a diverse range of financial instruments, including derivatives, and the regulatory requirements of such financial instruments, including access, disclosures, and trade flows.
  • Lead the processes for maintaining Investment Firm license and passporting under MiFID and other applicable laws and regulations.
  • Contribute to the process of maintaining the authorisation as crypto asset service provider under MiCA regulation.
  • Assist with continued compliance with MiCA, working across the Crypto.com enterprise in order to deliver projects under high priority deadlines.
  • Draft, review, and update policies/procedures and terms and conditions and other rules related to the trading of MiFID-regulated products.
  • Assisting in drafting, reviewing and updating policies/procedures and terms and conditions and other rules related to the trading of MiCA-regulated products.
  • Represent and lead the communication of Crypto.com on a variety of topics with NCAs, ESMA, and other relevant regulators.
  • Reviewing marketing and sales literature, presentations, and other educational materials for compliance with applicable MiFID and MiCA laws and regulations.
  • Work with external counsel to ensure our arrangements comply with relevant law and regulation in jurisdictions where we operate.

Requirements

  • Qualified/licensed lawyer with at least 5 to 10 years of experience in financial product legal and regulatory work handling issues for MiFID-regulated clients in a major law firm or as a licensed MiFID entity.
  • Excellent knowledge of EU financial law (MiFID, EMIR, IFR, IFD, MAR, etc) and track record of maintaining license under these frameworks.
  • Familiarity with industry practices and professional standards.
  • Experience implementing markets and traditional finance rules in the EU and on a cross-border basis with the U.S.
  • Familiarity with MiCA and willingness to work across the legal team on this new regulation.
  • Excellent English verbal and written communication skills.
  • Strong organizational/project management skills, ability to handle high volume and balance competing demands.
  • Ability to develop and maintain relationships with stakeholders.
  • Willingness to accommodate calls and meetings with different time zones when required.
  • Able to identify problems, issues and able to propose solutions.
