Our client is a leading telecommunications business who currently require a Commercial Manager to join their Asset Management team and support on a range of maintenance contracts.
This role will suit candidates who have strong bid experience and exposure to NEC contracts.
Job Summary
Working closely with the legal and commercial team, and the wider Project team to help provide commercial support and expertise to help ensure the business is exercising its obligations fully in line with the contractual requirements, and in a way that ultimately delivers both best value for the business and a customer.
Delivering pragmatic commercial support, including the management and negotiation of all but the most complex bids.
Key Deliverables
- Providing a pragmatic and value-add commercial support to all aspects of the business throughout the entire sales and delivery cycle
- Working closely with the businesses to develop relationships with, and an understanding of the commercial approach of the customers
- Providing Commercial support to all areas of the business
- Working with the team to maximise the profitability of the contracts whilst understanding the impact on future business
- Negotiating contracts to achieve a win/win for the business and its customers
- Working closely with the teams responsible for delivery to ensure a smooth contract handover and that the delivery teams understand the contract requirements, mechanisms and commercial assumptions
- Resolving disputes and claims with customers to meet the business' best interests
Responsibilities
- To serve as focal point of contact for customers and key stakeholders (internal and external) regarding contractual matters by establishing and managing good customer relationships and communications.
- To provide a contractual support and guidance to the business regarding terms and conditions and contractual obligations including regulatory requirements.
- To implement commercial strategy for proposals / tenders that maximise the commercial position whilst delivering tenders in accordance with competition rules, company processes and policies.
- To ensure company policies, processes and procedures are followed, consistently across the business including reviewing for improvements.
- To prepare, review and approve in line with company delegations proposed contract proposed contractual agreements and change requests / notices.
- Identify and implement complex sub-contract arrangements that mitigate commercial risk through the application of appropriate flow down terms and bespoke contracting methods.
- Understanding of the different types of risk and solutions which manage these risks throughout the lifecycle of the contract.
- Working collaboratively to review bids and contracts, to discuss and advise on the appropriate commercial structure of the deal/issue and to negotiate and draft contracts and correspondence with customers.
- You will also be the commercial representative on cost reviews and deal reviews and clearly present and summarise the commercial position to the reviewers.
- Provide training to Commercial Officers around the Order Acceptance process and assist with the Order Acceptance mailbox during peak times or to cover absence.
Qualifications/Experience:
- Degree/HND/HNC or equivalent in an appropriate discipline is desirable. Depth and breadth of experience will be taken into account where these qualifications have not been attained.
- Good interpersonal, organisational and communication skills.
- 10+ years of customer facing experience with excellent negotiation and communication skills.
- Ability to develop different types of commercial solutions in different circumstances.
- Ability to communicate at all levels in an organisation.
- Thorough understanding of commercial processes and typical contractual terms.
- Experience and understanding of different contract types (especially NEC) and different contracting structures including managing multiple prime/sub relationships and different types of joint venture arrangements.
