We are seeking an experienced and committed Court of Protection Solicitor (Health & Welfare) to join our growing team. This is an excellent opportunity to work in a highly specialised and rewarding area of law, representing vulnerable adults and their families in complex and sensitive matters.

You will manage a varied caseload of Health & Welfare Court of Protection matters, including applications and proceedings relating to capacity, best interests, residence, care and contact together and also applications brought under Section 21A of the Mental Capacity Act 2005.

Key Responsibilities
  • Managing a caseload of Health & Welfare Court of Protection matters.
  • Drafting applications, statements, and other court documents.
  • Instructing counsel where appropriate.
  • Advocacy and attendance at Court of Protection hearings (where appropriate).
  • Advising clients, family members, professionals, and deputies on capacity and best interests issues.
  • Working closely with the Official Solicitor, local authorities, medical professionals, and care providers.
  • Ensuring compliance with Mental Capacity Act 2005, Care Act 2014 and relevant case law.
  • Supervising junior team members where appropriate.
About You
  • Qualified Solicitor in England & Wales.
  • Demonstrable experience in Court of Protection Health & Welfare work.
  • Strong knowledge of the Mental Capacity Act 2005, Care Act 2014 and associated case law.
  • Knowledge of Civil Legal Aid preferable.
  • Excellent drafting, communication, and advocacy skills.
  • A compassionate, client-focused approach with the ability to handle sensitive matters and a strong focus on detail.
  • Ability to work independently while contributing positively to a collaborative team.
