My client, a tier 1 developer, are seeking a specialist Commercial Manager to be part of an essential cog in their Special Projects team and focus on a claims-based role. The role will be a stand-alone role, albeit within a commercial team, and a candidate who is experienced with and has suitable qualifications in commercial litigation, recoveries and/or contract mediation will be an ideal fit for the role. The position brings longevity, opportunity for progression, the chance to work under your own steam and have the flexibility to work 2 days a week, whilst still having the security and prospects that working for a tier 1 business brings.

Main duties:

  • Key account holder of recoveries from third party consultants, contractors.
  • Instruct experts, counsel, quantum and witness statements for building the clients defence.
  • Conduit for project teams to provide particulars, development of recoveries target matrix and regular updates of target.
  • Co-ordinated reporting of all live litigation actions both up and down stream.
  • Ensure compliance with the company’s Quantity Assurance Procedures and Health & Safety Policy.
  • Liaise with internal and external legal teams for defence claims.
  • Dispute resolution and contract awareness.
  • Attend design review meetings and pre-planning technical department meetings to understand the consequences on the development’s financial forecasts.
  • Work with build and commercial teams to ensure that the contractual position of the company is protected.
  • Provide accurate build costs for use in budgets, forecasts and valuations.
  • Ensure build cost information is up to date to enable accurate estimating.
  • Review and update forecasts and budgets, including for later sites.
  • Ensure that costs are kept within forecast and estimates where possible, and that the department operates within the guidelines determined.
  • Coordinate the measure and payments to subcontractors including guidance to Surveyors.
  • Coordinate cash flow forecasts of the recovery targets for each site.
  • Liaise with Technical, Development & Finance to ensure accurate & timely reporting of fee schedules.
  • Identify non-compliance and rectify and resolve problems.
  • Deal with queries from build teams arising from all teams, but specifically the build team.
  • Carry out monthly cost and value report for the Region.
  • Coordinate and check CVR’s and back up prior to the monthly meeting.

Desired experience:

  • Specific experience in contract litigation and determination of liability.
  • Experience working within a residential contractor or cost consultancy practice.
  • A good knowledge of the Building Safety Act and relevant statute for claims under this legislation.
  • Previous experience as a Commercial Manager within the industry.
  • A good understanding of building regulations and legal obligations.
  • Experience in commercial contracts for construction of residential properties with evidence of litigation or recovery actions achieved.
  • A member of Royal Institute of Chartered Surveyors (RICS).
  • Degree in Surveying, Building, Construction Law or similar.
