This Legal 500 firm with a broad spectrum of expertise in civil and commercial litigation are currently looking for an experienced and driven Senior Property Litigator to join their thriving Litigation team.
Role Overview
This Legal 500 firm is seeking a seasoned and highly capable Senior Property Litigator with a deep understanding of Landlord & Tenant law, property disputes, and boundary issues. The role will involve providing expert legal advice across a wide range of disputes affecting both commercial and residential landlords, tenants, and landowners. The successful candidate will have the opportunity to manage complex, high-value cases, representing clients across various sectors, both locally and nationally.
Key Responsibilities
- Manage a varied caseload, predominantly focused on property-related disputes, with the flexibility to handle broader contract-related issues as needed.
- Oversee landlord and tenant disputes, including lease renewals under the Landlord and Tenant Act 1954 and dealing with dilapidations claims.
- Handle residential possession cases, ensuring a solid understanding of housing laws and statutory regulations.
- Resolve disputes between adjoining property owners, including trespass, nuisance, boundary issues, and enforcement of restrictive covenants, while aiming to preserve amicable relationships between neighbours.
- Represent clients in disputes related to development projects, advising developers and those impacted by planning and construction issues.
- Provide advice on long residential leases, covering lease extensions, freehold enfranchisement, rights of first refusal, and setting up right-to-manage companies.
- Collaborate effectively with colleagues, clients, and external parties to deliver optimal legal outcomes, while supporting the firm’s commercial and residential property teams.
- Keep up-to-date with developments in property and contract law to offer clients accurate, timely advice.
Requirements
- Qualified Solicitor or Legal Executive with substantial experience in property litigation.
- A minimum of 5 years PQE in property litigation and commercial contract disputes.
- Strong background in landlord and tenant disputes, both residential and commercial.
- Proven track record in handling disputes between adjoining owners is essential.
- Experience in residential long lease work is advantageous, with the firm offering training for those looking to develop in this area.
