At HealthTrust Europe (HTE), we have an exciting opportunity for a Senior Legal Counsel to join our thriving organisation, as part of our Legal team. As Senior Legal Counsel you will play a key role in supporting HTE and HCA stakeholders, providing specialist legal advice on the Procurement Act, the Provider Selection Regime and the Public Contracts Regulations. You will be a qualified solicitor with a minimum of two years post-qualification experience gained either in-house or in private practice, with demonstrated expertise in public procurement.
Based in Edgbaston, Birmingham, we offer solutions to manage spend effectively and improve performance, working with both public and private healthcare and non-healthcare providers to optimise the use of products and services to identify cost saving opportunities and best value.
As Senior Legal Counsel, your duties & responsibilities will include the following, in no particular order:
- Assist business clients in development of contracting strategy and implementation in compliance with the Public Contracts Regulations 2015 and the Procurement Act 2023 and the Provider Selection Regime.
- Provide legal guidance on compliance with various laws and regulations, especially the Public Contracts Regulations, the Procurement Act 2023, the Provider Selection Regime, the Data Protection Act and the GDPR, the Bribery Act and FCPA and the Competition Act.
- Provide specialist legal advice on all aspects of public procurement and commercial contracting, supporting the business in the development of frameworks, through the full procurement lifecycle from strategy and tender design to evaluation, award, and contract management.
- Advise on compliance with applicable procurement legislation (including the Procurement Act 2023 and legacy PCR 2015 frameworks), drafting and negotiating procurement and contractual documentation, managing legal risk, and supporting governance and decision-making processes.
- Provide leadership across the Legal team, with people management responsibility for junior solicitors, trainee solicitors, paralegals and legal administrators; training any necessary gaps in knowledge, skill or competence.
- Review areas of competence, responsibility and career development for direct reports.
- Provide legal advice on public procurement matters, including compliance with the Public Contracts Regulations 2015, the Procurement Act 2023 and other applicable statutory and regulatory frameworks.
- Draft, review and negotiate a wide range of procurement and commercial agreements (including framework agreements and call-off contracts), manage legal and commercial risk, and provide pragmatic, solutions-focused advice on contractual and procurement issues.
- Draft agreements and templates, coordinate with the internal business client to ensure proper legal documents are used, review edits proposed by other contracting parties, negotiate with the other party to arrive at mutually acceptable language, and assist the business client in finalising the documents for signatures.
- Assist in the drafting of policy and procedure regarding the contracting process and ethics and compliance matters.
- Support with the drafting of relevant company policies.
Private practice experience preferable, commercial experience, Legal Practice Course or Bar Vocational Course, independent handling of legal review of agreements, at an advanced level. Proven ability to simultaneously manage a high volume of legal projects and a wide variety of legal issues. Healthcare legal experience desired.
