HarKaye is exclusively instructed by a respected national law firm to recruit an experienced Court of Protection Solicitor to join their growing Property & Affairs team. This is a fantastic opportunity to manage a varied and meaningful caseload, supporting vulnerable individuals who lack capacity to manage their financial affairs.
You will play a key role in delivering high-quality legal services to clients and their families, providing practical guidance across a range of Property & Affairs matters. You’ll work closely with deputies, medical professionals, external financial advisers, care providers, and internal teams to safeguard clients’ assets and wellbeing.
Key Responsibilities- Manage a diverse caseload of deputyship and attorneyship matters under the Mental Capacity Act 2005.
- Prepare and manage Court of Protection applications including statutory wills and gifting.
- Advise on property transactions, asset management, financial reporting, and expenditure approvals.
- Liaise with the Office of the Public Guardian, local authorities, investment managers, and banks.
- Prepare detailed reports, schedules of expenditure, witness statements, and supporting documents.
- Provide empathetic communication and support to vulnerable clients and their families.
- Ensure compliance with regulatory standards, safeguarding duties, and financial controls.
- Collaborate with other practice areas on cross-disciplinary work when required.
- Qualified Solicitor
- Strong background in Court of Protection Property & Affairs work (essential).
- Clear understanding of COP Rules, OPG requirements, and the Mental Capacity Act 2005.
- Excellent interpersonal skills and confident working with vulnerable individuals.
- Strong organisational and financial management abilities.
- Ability to work autonomously and within a supportive specialist team.
- Experience advising on statutory wills, gifting applications, and trust matters.
- Exposure to high-value deputyship matters linked to catastrophic injury awards.
- Comfortable liaising with case managers, care providers, and investment advisers.
