Role overview

The Construction Lawyer will provide expert legal support across the full lifecycle of Green Scale’s data centre and infrastructure projects, from land acquisition and pre-construction through to construction, delivery and operation.

Reporting to the General Counsel, this role will play a central part in structuring, negotiating and managing construction and engineering contracts, and in managing risk across a fast-moving, capital-intensive development programme.

You will work closely with the Development, Construction, Commercial and Finance teams, supporting projects across multiple European jurisdictions and covering a broad range of commercial and general legal work beyond construction matters.

The role is hands-on and commercially focused, suited to someone who can provide pragmatic advice at pace and help teams make confident decisions in a high-growth environment.

Key Responsibilities

• Contract Drafting & Negotiation
• Draft, review and negotiate a broad range of construction and engineering contracts, including build-to-suit, powered-shell, turnkey, design-and-build and EPC arrangements.
• Advise on and negotiate pre-construction services agreements, professional appointments, collateral warranties, framework agreements and subcontracts.
• Work with standard-form contracts (including FIDIC, JCT, NEC and bespoke international forms) and adapt them to project and jurisdictional requirements.
• Prepare and negotiate ancillary documentation, including bonds, guarantees, parent company guarantees and letters of intent.
• Project & Risk Management
• Provide practical, commercially focused legal advice throughout the project lifecycle, from procurement and mobilisation to completion and handover.
• Identify, assess and mitigate legal and contractual risk across the development programme.
• Advise on contractual mechanisms including variations, extensions of time, liquidated damages, payment and termination.
• Lead and manage the contentious elements of projects, including construction disputes, claims, adjudication, mediation and litigation or arbitration, working with external counsel where appropriate.
• Manage day-to-day risks and legal issues arising across the project portfolio, escalating material matters to the General Counsel as appropriate.
• Commercial & General Legal Support
• Cover a broad range of commercial and general legal work in support of the business, beyond construction matters.
• Support commercial and contract matters in respect of tenders, procurement, negotiations and ongoing operational matters.
• Advise on project finance arrangements and support financing workstreams as they interface with project delivery.
• Support the General Counsel on strategic, corporate and other legal matters as required.
• Cross-Jurisdictional & Stakeholder Support
• Support projects across multiple European jurisdictions, coordinating with local counsel on matters of local law and procedure.
• Advise internal stakeholders, including the Development, Construction, Commercial and Finance teams, in a clear and accessible manner.
• Support land acquisition, real estate and planning workstreams as they interface with construction delivery.
• Advise on sustainability, renewable energy and community-related contractual obligations relevant to Green Scale’s development model.
• Governance & Continuous Improvement
• Contribute to the development and maintenance of template documents, playbooks and internal processes.
• Support the instruction and management of external legal advisers, including managing budgets and delivery.
• Keep abreast of legal and regulatory developments affecting construction, infrastructure and data centre projects.
• Support, supervise and mentor more junior members of the legal team.

Key Skills & Qualifications

Essential Skills & Experience

• Qualified solicitor (England & Wales) with significant post-qualification experience in construction and engineering law; equivalent qualifications in other jurisdictions may be considered.
• Demonstrable experience advising on major construction, engineering or infrastructure projects, ideally including data centres.
• Strong drafting and negotiation skills across a range of construction contracts and standard forms (FIDIC, NEC, JCT or equivalent).
• Sound understanding of construction risk allocation, project delivery structures and contractual claims.
• Ability to provide pragmatic, commercially oriented advice in a fast-paced development environment.
• Excellent communication skills, with the ability to explain complex legal issues clearly to non-legal stakeholders.
• Ability to cover a broad range of commercial and general legal work in addition to construction matters.

Desirable Skills & Experience

• Experience of cross-border or multi-jurisdictional projects, particularly across Europe.
• Experience in the data centre, digital infrastructure, energy or renewables sectors.
• Familiarity with real estate, planning and procurement issues as they relate to development projects.
• Experience working in-house or on secondment to a developer or contractor.
• Experience of project finance and financed infrastructure projects.
