Role: Court of Protection Solicitor

Leading law firm looking to recruit dedicated Court of Protection Solicitor for highly sought permanent positon.

Court of Protection Background:

Our Client's Court of Protection Department provides expert legal advice and representation to vulnerable individuals, their families, and professional deputies in matters relating to the Mental Capacity Act 2005. The team acts in a broad range of Health & Welfare and Property & Affairs matters, including deputyship applications, welfare disputes, deprivation of liberty challenges, statutory wills, trust matters, and ongoing deputyship administration. Team is committed to delivering outstanding client care, safeguarding the interests of vulnerable clients, and achieving practical, client-focused outcomes.

The team is fast growing and very busy. The team works closely together and prioritises providing a high level of client care and a very efficient service.

Main Duties and Responsibilities

The successful candidate will have a genuine interest in Court of Protection work, demonstrate a strong understanding of mental capacity law, and be committed to delivering exceptional client care to vulnerable clients. They will be capable of handling both Health & Welfare and Deputyship matters while contributing positively to the growth and success of the department.

  • Report directly to the Department Director.
  • Manage a varied caseload of Court of Protection matters, including Health & Welfare, Property & Affairs Deputyship, and related applications.
  • Conduct day-to-day case management, including preparing applications, reports, legal documents, and correspondence.
  • Liaise with clients, families, capacity assessors, financial advisers, local authorities, and other professionals.
  • Assist with deputyship administration, OPG reporting requirements, and welfare-related matters.
  • Maintain accurate file management, compliance, and time recording procedures.
  • Provide support and guidance to junior team members where appropriate.
  • Implement recommendations arising from file reviews and supervision.
  • Support business development, networking, and marketing initiatives within the department.
  • Deliver excellent client care while managing deadlines and maintaining high professional standards.

Key Skills Required

  • Qualified Solicitor with 0-3 years' PQE and a clean, valid Practising Certificate.
  • Experience in Court of Protection matters, including Health & Welfare and/or Property & Affairs Deputyship work.
  • Good knowledge of the Mental Capacity Act 2005, Court of Protection practice, and relevant procedures.
  • Experience managing caseloads, preparing applications, reports, and legal documents, and meeting deadlines.
  • Strong client care skills with the ability to work sensitively and effectively with vulnerable clients and their families.
  • Excellent communication and interpersonal skills, with the ability to engage confidently with clients, professionals, and stakeholders.
  • Strong analytical, organisational, and problem-solving abilities, with attention to detail.
  • Ability to work independently, use sound judgment, and contribute effectively as part of a team.
  • Commercial awareness and an interest in business development and networking activities.
  • Proficient IT skills, including Microsoft Office and case/document management systems.
  • Mental Capacity Accreditation and advocacy experience would be advantageous but are not essential.
