Description

We are looking to hire an experienced Court of Protection Solicitor to join our dedicated and growing Court of Protection team within our Wills, Probate, Tax & Trusts department.

As a Court of Protection Solicitor, you will work closely with the firm’s Panel Deputy to deliver person centred support to protected parties.

You will provide expertise in cases relating to the wellbeing of individuals who lack capacity to manage their property and financial affairs as well as having a good understanding of interplay of health and welfare decisions within the property and finance field. You will be providing technical expertise and guidance to other team members.

You will manage a comprehensive caseload efficiently, ensuring that all matters are handled within specified timeframes and with a high level of professionalism.

Reporting to the Head of Wills, Probate, Tax & Trusts. This is a full-time permanent role.

Key Responsibilities

  • Provide expert advice and representation to clients in Court of Protection cases, including applications for deputyship, statutory wills, property and finance decisions and related trust matters.
  • Prepare and review legal documents, including court applications and financial reports.
  • Run deputyship cases.
  • Manage cost applications.
  • Deal with matters relating to nursing or residential home funding.
  • Deal with deprivation of liberty and safeguarding matters.
  • Ensure compliance with file management procedures.
  • Stay updated on changes in legislation and case law relating to the Court of Protection, ensuring compliance and the provision of accurate advice.
  • Have a professional pro-active approach, strong client care skills and be interested in Business Development and Marketing to supplement the substantial work volumes brought in by the firm.
  • Take on additional tasks as reasonably required by the Head of Wills, Probate, Tax & Trusts.

Skills, Knowledge & Expertise

  • Be a qualified Solicitor or Chartered Legal Executive with a minimum of 3 years\’ experience running your own Court of Protection caseload.
  • Strong knowledge and understanding of the Mental Capacity Act 2005 and associated legislation.
  • Proven experience in managing a caseload of Court of Protection matters.
  • Excellent analytical, research, and problem-solving skills.
  • Exceptional verbal and written communication skills, with the ability to communicate complex legal concepts to clients and stakeholders.
  • Strong advocacy skills and experience representing clients in court.
  • High level of professionalism, integrity, and ethical conduct.
  • Ability to work independently, prioritise tasks, and meet deadlines.
