Elite Personnel is delighted to be recruiting on behalf of a well-regarded and growing law firm seeking an experienced and committed Solicitor in their Court of Protection department to join their specialist team. This is an excellent opportunity to work within a highly specialised and rewarding area of law, representing vulnerable adults and their families in complex and sensitive matters. The successful candidate will join a supportive and collaborative team handling high-quality, meaningful work.
The Role
- Manage a varied caseload of Health & Welfare Court of Protection matters, including:
- Applications and proceedings relating to capacity and best interests
- Residence, care and contact disputes
- Applications brought under legislation
Key Responsibilities
- Managing a caseload of Health & Welfare Court of Protection matters
- Drafting applications, statements and other court documentation
- Instructing counsel where appropriate
- Advocacy and attendance at Court of Protection hearings (where appropriate)
- Advising clients, family members, professionals and deputies on capacity and best interests issues
- Working closely with the Official Solicitor, local authorities, medical professionals and care providers
- Ensuring compliance with the legislation and relevant case law
- Supervising junior team members where appropriate
About You
- Qualified Solicitor in England & Wales
- Demonstrable experience in Court of Protection Health & Welfare work
- Strong knowledge of the Mental Capacity Act 2005, Care Act 2014 and associated case law
- Knowledge of Civil Legal Aid (desirable)
- Excellent drafting, communication and advocacy skills
- Compassionate, client-focused approach with the ability to manage sensitive matters
- Strong attention to detail
- Ability to work independently while contributing positively to a collaborative team
