Carson McDowell’s Regulatory and Professional Discipline Team represents the interests of regulated professionals and commercial clients across the health and social care sectors. The Team represents clinicians in fitness to practise proceedings before their regulatory bodies, primarily the General Medical Council and General Dental Council. We also assist clients with disciplinary proceedings, Ombudsman’s investigations, criminal cases, public inquiries and coronial matters, regularly including high profile cases. We are investing in and expanding our Healthcare Team in England and are looking for ambitious, motivated legal professionals at all levels who have a passion for healthcare work. This role offers significant flexibility, and applications from fully remote candidates will be reviewed. However, candidates should be willing and able to attend the office periodically for team collaboration, client engagement, and business requirements on occasion. Candidates will ideally have experience of healthcare work, but those with broader regulatory and professional disciplinary experience will also be considered. Main Responsibilities • Managing a diverse caseload of fitness to practise investigations, including high profile matters, from initial referral/investigation, through to any interim orders hearings, substantive hearing and appeal. Our caseload includes a mix of misconduct, professional performance and health cases. This includes: Undertaking detailed evidential analysis in order to provide clear, strategic and commercially aware advice on procedural and evidential issues, likely sanctions and consensual disposal where applicable. Collating evidence, taking witness statements, preparing hearing bundles, evidence schedules, chronologies and case summaries. Advising on grounds for administrative challenge to the procedural position adopted by regulators where appropriate and conducting judicial review proceedings. • Advising clients in relation to all procedural and evidential aspects of disciplinary proceedings by healthcare trusts. • Representing clients at police interview and criminal trial. • Advising clients in relation to coronial investigations, including the drafting of statements, advising on evidential matters and conducting advocacy at preliminary hearings and/or inquest hearings. • Representing clients at public and statutory inquires. • Supervising and mentoring trainee or junior solicitors, paralegals and legal secretaries, ensuring high standards of accuracy, client care and case progression. • Developing and maintaining strong relationships with clients, regulators, professional bodies, counsel and experts. • Complying with file management, time recording, billing, confidentiality, data protection, equality and diversity, and professional conduct requirements. • Keeping up to date with developments in regulatory and coronial law, professional standards, disciplinary procedure, case law and continuing professional development requirements. • Supporting and engaging with the full Healthcare Team in relation to Business Development activity, related to the healthcare sector, to include article writing and attending/presenting at specialist healthcare events.
