Join to apply for the Associate - Advisory & Inquest role at Browne Jacobson. This is an exciting opportunity to join one of the largest teams in the country, ranked Tier 1 nationally in Chambers for this area of work.

In this role, you’ll undertake inquest Court of Protection work for a wide range of public and private sector health and social care clients. Working out of one of our Regional Offices, we’re seeking an Associate to manage a caseload of inquest and Court of Protection (including some advocacy) matters primarily for the NHS, with opportunities to work for independent sector health and social care clients and local authorities as well. Our inquest and Court of Protection practice covers cases nationally.

You’ll work in a team that provides a range of high‑quality legal services on complex matters. The department also conducts a range of other health and social care advisory issues, including:

  • Inquests
  • High Court serious medical treatment cases (children and inherent jurisdiction)
  • Mental health
  • Mental capacity
  • Deprivation of liberty
  • Intervenor proceedings in the Family Court
  • Welfare planning disputes
  • Safeguarding
  • Access and funding disputes
  • Continuing healthcare/Individual Funding Requests
  • Information governance/DPA/FOI
  • Judicial review
  • Human Rights Act claims

Experience in any of these additional areas, whilst not essential, would be an advantage and there will be opportunities for successful candidates to develop these areas of work as well.

Person specification

Technical skills

  • Experience relating to Court of Protection including health and welfare applications and S21A MCA 2005 challenges and/or serious medical treatment applications to the High Court.
  • Advocacy and case management skills gained in Court of Protection or inquests, or other relevant setting.
  • Experience in health and social care advisory matters would be an advantage – including mental health, adult safeguarding, responsible commissioner advice, professional advisory on health and social care legal matters including consent, Continuing Healthcare, access and funding disputes.
  • Presentation skills to deliver training to clients or internally on relevant health and social care legal topics.
  • Attention to detail with the ability to explain/advise clients on complex technical aspects of process and procedure.
  • Able to prepare complex written advice to clients, being willing to learn and comply with client Protocols and Service Level Agreements.
  • Familiarity with IT (Microsoft Office 2010), and ideally with experience of appropriate case management systems.
  • Good understanding of the NHS.
  • Familiarity with online and library research facilities.
