Assistant Director, Legal Services and Enforcement in Hamilton

The Bermuda Monetary Authority (Authority or BMA) invites skilled and capable individuals to apply for the vacancy of Assistant Director - Enforcement in our Legal Services and Enforcement Department. Reporting to the Deputy Director - Enforcement, the incumbent will be responsible for performing a range of legal and technical enforcement activities, including applying advanced analytical skills and providing legal advice regarding matters of regulatory misconduct, drafting legal documents, and representing the Authority in hearings/appeals, etc. as necessary.

This is a key role for the Authority and the incumbent will be responsible for, but not limited to:

• Providing legal advice and recommending appropriate courses of action to line departments regarding the exercise of compliance and enforcement functions by their officers, as well as providing legal advice on other aspects of the Authority’s functions and activities as required by the Deputy Director.
• Assisting the Deputy Director, as required, with the Authority’s financial crime functions, including supporting the implementation of the Authority’s framework for supervising and enforcing financial institutions’ compliance with Anti-Money Laundering/Anti-Terrorist Financing (AML/ATF) regulations, and regularly reviewing the Authority’s processes and underlying legal framework to ensure the effective and efficient delivery of these functions.
• Assisting in the coordination of litigation activities on behalf of the Authority against individuals and institutions, including participating in civil litigation and winding-up proceedings involving the Authority, as directed. This includes instructing external counsel, preparing pleadings, affidavits and other court documents, participating in discovery processes and providing general support in the conduct of litigation.
• Supporting the Authority’s enforcement and regulatory processes, including conducting witness interviews and documenting all case-related activity. This includes reviewing and analysing complex information and documents required to develop enforcement cases.
• Investigating potential regulatory breaches and misconduct by applying financial analysis techniques, interviewing senior management, taking witness statements and affidavits, and documenting all case-related activity to support the development and evidencing of enforcement cases.
• Assisting with the development of timely departmental budgets and supporting effective financial management by ensuring appropriate controls are in place to monitor operations and maintain accountability for expenses in line with the Authority’s goals and objectives.
• Reviewing, in conjunction with management, situations where projects or time-critical tasks may be outsourced, and overseeing approved consultancy activities to ensure desired outcomes are achieved within budget.
• Managing senior-level staff by providing technical and administrative guidance, supporting the achievement of departmental goals, identifying employee training and development needs, and monitoring performance through regular mentoring, feedback and formal appraisals in line with the performance management process.
• Representing the Authority, as required, at local and international meetings, conferences and seminars, including engagements and information exchanges with regulatory bodies, government agencies and the financial services industry, while developing and maintaining key relationships and keeping abreast of industry trends.

This position requires a proven technical and business background; therefore, the incumbent must have the following:

• An accredited law degree and admission as a barrister or solicitor in Bermuda or another Commonwealth jurisdiction.
• Minimum of ten (10) years post-qualification experience, with at least six (6) years in commercial litigation and financial services law, gained through private practice, the financial services industry or a financial services authority.
• Proven knowledge of Bermuda’s insolvency and restructuring law, administrative law, financial services law and relevant AML/ATF legislation.
• Strong analytical, interpersonal and written and oral communication skills.
• Strong research capability, resourcefulness and sound judgment, with the ability to engage effectively with the financial services industry, government and international regulatory bodies.
