As Contract and Claims Manager, you are responsible for managing contracts for our design and construction projects. You prepare the contracts as well as any change requests, process complexities like deviations, project disruptions and contractual disputes. You examine claims and reject unjustified claims. You prepare, execute and support claims negotiations and act as a third party to support the enforcement of counterclaims.
The ideal candidate should possess thorough knowledge of contract language, claim process and legal requirements of design and construction contracts across a variety of contract types.
Responsibilities- Managing building project contracts and claims for various projects of the company by working with project manager, construction manager and other stakeholders.
- Identifying, notifying, enforcing or defending changes/claims (passive/active) coming from/towards third parties as well as managing risks and opportunities related to claims.
- Preparation of claims in accordance with the contract.
- Preparation of defense against incoming claims and creation of counterclaims.
- Preparation of extension of time claims, prolongation costs, acceleration costs.
- Preparation of routine notices, and correspondences in accordance with the contract terms.
- Ensuring that all notices of claims and/or further and better particulars are submitted to relevant parties timely and in accordance with the contract.
- Update and maintain a claim register to track company's claims against the client, consortium partners (if any), contractors and vice versa and regularly update the project team of its status.
- Establishing and enforcing commercial policies and standard procedures in regard to change requests and claims.
- Attending internal and external meetings as may be required by the company.
- Creating overall awareness about contractual claims and ensuring internal stakeholders understand relevant contractual terms and conditions.
- Accredited degree or global equivalent in Business, Construction Management, or Law.
- Relevant experience with major architects, engineers and/or contractors in roles dealing with management of project change procedures, cost management, claims and variations, negotiation and settlement of disputes with owners and subcontractors.
- Experience developing and negotiating contract terms and conditions specifically for contracts related to design and engineering services, construction, materials and equipment installation.
- Strong understanding of contracting principles and legal terms and conditions.
- Broad understanding of the construction industry and contract language associated with architecture, engineering, procurement, fabrication and construction.
- Excellent oral and written communication skills with the ability to write good contractual correspondences.
