The successful applicant will handle a caseload of pre and post-prosecution actions in the Magistrates Court, brought under the Environmental Protection Act 1990. Focusing on all aspects of the prosecution of both private and social landlords, you will handle cases from inception to conviction or settlement, whilst complying with the Criminal Procedure Rules and duties of private prosecutors.
Responsibilities
- Run a caseload of pre- and post-prosecutions Environmental Protection Act matters on behalf of tenants.
- Comply with the relevant Criminal Procedure Rules, Magistrates Court Act and CPIA 1996.
- Knowledge and understanding of relevant legislation, such as the Environmental Protection Act 1990.
- Draft and/or approve Notices of Intended Prosecution.
- Delegate drafting of Summonses, information's and applications for issue of a Summons under Crim PR Part 7.
- Review Prosecution files on a regular basis.
- Lay Information's at the Magistrates Court.
- Review Environmental Health Officers reports – Prosecutor and Defendant.
- Consider Disclosure reviews and Defence Case Statements.
- Negotiation and settlement or Trial Preparation.
- Liaise with internal and external counsel.
- Use Proclaim (claims management software) competently and effectively, ensuring that business process and policy is adhered to.
- Communicate effectively with clients, Defendants and other stakeholders.
- Liaise with and build positive and professional relationships across the business.
- Carry out other duties, as and when required, to assist in the smooth running of the business.
Our team structure means that we can support applicants with varying degrees of prior experience and have successfully supported several staff who have re-trained from fast paced Criminal litigation backgrounds such as General Criminal Defence.
Qualifications
- Successful candidates will be confident communicators with a high level of written and verbal skills and good attention to detail.
- You must be well organised and able to work in a busy environment with the ability to prioritise tasks and work to tight timescales.
- Fully qualified Solicitor.
- Criminal Prosecution or Defence experience is essential.
- Able to bill work at Grade B or above.
- Case Management System (Proclaim) experience is a must to handle volume litigation.
- Demonstrable experience of being able to work at pace, with ability to manage competing priorities within own caseload.
- Experience of advocacy and handling own files from pre-plea to trial.
- Highly organised and self-motivated.
- IT literate.
