The Commercial Claims Manager will manage and resolve legacy claims arising from construction projects in the UK. The role will include ensuring effective commercial and legal strategies that align with the business’s objectives, as well as maximising insurance recoveries, thereby safeguarding the company’s financial and operational interests. The role involves leading investigations, providing strategic advice, managing legal and financial risks, and ensuring cost-effective resolutions through collaboration with project teams, the legal department, and external advisors. Additionally, it supports the business by disseminating commercial insights, delivering training and mentoring more junior staff members.
Other key responsibilities will include:
- Working as part of a busy legal team, primarily based in Central London, to provide commercial and strategic advice on legacy claims issues arising from construction projects in the UK
- Providing high-quality commercial advice without requiring external legal support, where appropriate
- Keeping project teams, the legal team, and the Senior Leadership Team (SLT) updated on legacy claims strategies
- Disseminating advice on commercial issues to project teams and the wider business
- Leading on legacy claims (both informal and formal) with employers and supply chain members, in conjunction with the legal team
- Forensically investigating legacy claims and gathering/analysing relevant information
- Providing and implementing solutions and strategies that align with the business’s objectives, commercial arrangements, and preferred risk profiles
- Progressing remediation of claims where appropriate, ensuring alignment with project teams, to provide cost management advice and scrutiny for the carrying out of such remedial works
- Selecting, instructing, and managing external lawyers and experts, including oversight of budgets and programmes
- Leading on the pursuit of insurance recoveries for legacy claims in collaboration with the Insurance Director
- Providing cost management advice and scrutiny for remedial works related to legacy claims
- Preparing and delivering commercial training and mentoring for both commercial and non-commercial staff
What do I need to be successful in this role?
- Proven experience within a similar-minded organisation
- A detailed knowledge of the core principles of commercial management and construction law
- Familiar with JCT contracts – familiarity with other contract forms would be advantageous but not essential e.g. NEC 3 or 4
- Commercial leadership
- Ability to identify commercial risks and opportunities and direct others accordingly
