Superior Recruitment Group have a fantastic opportunity available in Somerset for a Commercial Director. This is a Permanent position. The Commercial Director reports directly to the Operations Director and is responsible for delivering all commercial and contractual aspects of the contract, including but not limited to matters across the portfolio of contracts which encompass the master agreement, reporting, project controls (including planning), payments and finance.
Responsibilities:
- Develop the commercial strategy and ensure the organisation is aligned with internal legal entities, whilst demonstrating clear goals, deliverables, targets and objectives.
- Provide NEC acumen and give support/guidance to the entities and the project team to enable effective use and understanding of key terms.
- Review, analyse and challenge monthly project performance reports, including validation of receivables, Work In Progress (WIP) and working capital performance, ensuring consistency and standardisation of reporting and best practice across the contract.
- Provide detailed analysis of underperformance across the portfolio of contracts and deliver intervention plans to mitigate risks and return performance to the required levels, including actions to resolve disallowed costs.
- Provide the Operations Director with a commercial operating culture through standardised commercial reporting mechanism, controls and performance data so that the portfolio of contracts are delivered compliantly, effectively with transparency.
- Responsible for and ownership of any disputes, both internal and external, across the portfolio of contracts ensuring timely resolution.
- Ensure the timely clearance of all EWNs (Early Warning Notices) and CEs (Compensation Events) coupled with reviews in Risk Registers.
- Define the commercial organisational requirements (at PMO and within legal entities), responsibilities, recruit, coach, train and develop the commercial team, whilst ensuring that communications between all the business entities are clear/understood.
- Organise, manage, and actively participate in performance reviews, work with the team/s and/or regions to ensure that withheld amounts are mitigated and/or minimised on a monthly basis.
- Review and validate rates, margin models, cash-flow forecasts, and all commercial aspects of tender submissions, ensuring commercial terms including payment terms, Parent Company Guarantees (PCGs) and bond requirements, etc., are within acceptable limits and associated margin models take cognisance of these.
- Aid in the recovery plans for those not meeting expectations.
- Ensure that the AFP process is applied correctly and uniformly by all Legal Entities and that the AFP submissions are made on time to the client.
- Provide commercial leadership/assistance in new tender reviews and contract handover to the responsible entity / attend operational kick-off meetings supporting the entities through the transition from tender team to delivery team.
- Lead commercial stakeholder management with the client in order to mitigate any losses, as and when required develop a claim management strategy to ensure optimum financial recovery.
- Work alongside the Operations Director to ensure that yearly budgets are developed, coupled with accurate monthly forecasts.
- Ensure all plans are provided timely and in accordance with the master contract and where there are gaps, work with the entities to ensure all deliverables are captured and closed out.
- Work in conjunction with the other Commercial Directors to manage initiatives ensuring they are identified, recorded and driven through the process, ultimately delivering tangible and measurable commercial benefits for the business.
- Carry out monthly site visits and engagement with the site team to drive commercial performance and ensure innovations and improvements are planned, resourced and being delivered, coupled with providing details lessons learned.
- Work alongside and provide support to the other regional commercial directors/regional commercial managers to assist with client audits.
- Travel will be required for this position, 2-3 days a month to other business locations in Hull, Warrington, Germany and France.
